în cadrul  VERTICAL DESIGN S.R.L.

regarding EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC

VERTICAL DESIGN S.R.L. (hereinafter referred to as the "Company" or "Society")  complies with Regulation (EU) 2016/679 of the European Parliament and of the Council, concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, applicable as of May 25, 2018.

As this is a European Regulation, it applies directly and uniformly to all Member States of the European Union, in order to strengthen and unify security policies in the online environment and to better protect the data of all European citizens.

Respecting privacy and protecting personal data are fundamental principles to which our organization has given the importance and attention they deserve. Without understanding, awareness, and implementation of these principles, the current activities of the company cannot comply with the requirements of the aforementioned European Regulation.

One of the fundamental principles of this Regulation is transparency, and through this General Privacy Policy, we aim to inform you about how we collect, use, transfer, and protect your personal data.

We reserve the right to update, revise, and periodically modify this General Privacy Policy. In the event of changes, we will post the updated and revised version of the General Privacy Policy on our website.

This General Privacy Policy pertains to the personal data of customers, suppliers, other individuals who contact us and visit us, as well as their representatives, potential collaborators and collaborators, and it applies to data collected through our website, vertical.ro, as well as to all other personal data we collect via email and contact forms.

VERTICAL DESIGN S.R.L. (denumită în continuare, SOCIETATEA/COMPANIA) este o persoană juridică de naționalitate română, având sediul social în Mun. Ploiesti, Parcul Industrial Ploiești, 100213, Șos. Ploiești-Târgoviște, km. 8, Str. Piramidei nr. 6 A, având numărul de înregistrare la Registrul Comerțului de pe lângă Tribunalul Prahova J29/526/2012 și Cod unic de înregistrare RO 12525284.

In terms of data protection legislation, we act as the CONTROLLER atunci când prelucrăm datele dumneavoastră cu caracter personal. Pentru ca datele persoanelor fizice vizate să fie prelucrate în siguranță, am depus toate eforturile să implementăm măsuri rezonabile pentru a proteja informațiile  personale ale acestora.

Ploiești-Târgoviște, km. 8, Str. Piramidei nr. 6A, with mention: Attention Customer Relations Department.

• Terms of the Regulation:
  • Operator - the entity - in this case - VERTICAL DESIGN S.R.L., or any other legal person, public authority, agency, or non-governmental organization, which processes or determines the purposes and means of processing personal data.
  • Personal Data- any information about an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, by reference to an identifier: name, address, personal identification number, email, phone, income, biometric data, image, IP address, or by reference to medical, genetic data, data on ethnic origin or race, political, religious, philosophical, cultural beliefs, or trade union membership.
  • Data Subject -any natural person whose personal data can be or is processed by the controller.
• Purpose of the General Privacy Policy:

When a data subject enters into any kind of relationship with us, they entrust us with their information.

The purpose of this General Privacy Policy is to explain to data subjects what data we process, why we process it, and what we do with it - in our capacity as the controller. We take confidentiality seriously and never transmit or sell any personal data of our clients, be it customer data, lists, or email addresses. Fully aware that personal information belongs to each individual, we do our utmost to store and process it securely. We do not provide information to third parties without first informing the data subjects. This information is important, and we hope it will be read carefully.

Această Politică Generală de Confidențialitate nu acoperă aplicațiile și site-urile altor terți la care persoanele pot ajunge prin accesarea link-urilor de pe site-ul nostru. Acest lucru excede controlului nostru. Încurajăm toti vizitatorii să examineze Politica de confidențialitate de pe orice site și/sau aplicație înainte de a furniza date personale.

This general privacy policy also covers the recruitment and selection process of candidates for positions offered by the company (de ex. – compania obține date cu caracter personal ca urmare a solicitării/ completării unui formular dintr-o aplicație sau prin primirea unui CV – prin e-mail sau la secțiunea Cariere de pe site). Compania aduce la cunoștința solicitanților datele personale care le vor fi colectate, scopul în care sunt colectate și cum vor fi utilizate, in strânsa legatură cu existenta  prezentei Politici de confidentialitate formulata de companie (în operațiunea de recrutare pe e-mail cat si în secțiunea Cariere de pe site, există un link către politica de confidențialitate).

3. CATEGORII DE DATE CU CARACTER PERSONAL. SCOPURI ȘI TEMEIURI PENTRU PRELUCRARE:

În contextul interacțiunii dvs. cu VERTICAL DESIGN S.R.L.,  dvs. ca persoană fizică – iar în sensul Regulamentului – persoană fizică vizată, puteți face obiectul activităților de prelucrare a datelor pe care le efectuăm.

VERTICAL DESIGN S.R.L. poate solicita și/sau colecta informații de la dumneavoastră în mod voluntar atunci când:

Daca sunteți clienți ai companiei noastre, datele cu caracter personal pe care le prelucrăm sunt: nume, prenume, data naşterii, sexul,adresa de facturare, adresa de livrare, informatii financiare, e-mail și număr de telefon şi informaţii suplimentare pe care decizi în mod voluntar să le partajezi.

3.4 Dacă aplicați pentru un loc de muncă în cadrul VERTICAL DESIGN S.R.L.:

Folosim datele cu caracter personal conținute în CV-urile pe care le primim pentru a evalua calificările solicitanților pentru o poziție în cadrul companiei noastre, pentru a comunica cu aceste persoane în vederea recrutării, pentru îndeplinirea măsurilor precontractuale încheierii contractului individual de muncă (dacă recrutarea are succes), ori îndeplinirii interesului nostru legitim în legătură cu acest scop al prelucrării. Ne întemeiem în acest caz pe efectuarea demersurilor efectuate cu scopul încheierii și executării unui contract de muncă.

The categories of data processed in the context of our relationship with you are your name, email address, phone number, address, personal data included in CVs, details about education and training, professional qualifications, as well as other personal data that you may provide directly.

În acest caz, prelucrarea datelor va avea la baza consimțământul dumneavoastră, ori efectuarea demersurilor de către Societate înainte de încheierea contractului de muncă, ori îndeplinirea unei obligații legale a Societății, ori un interes legitim al Societății în legătură cu scopul prelucrării, ori protejarea intereselor vitale ale persoanei vizate sau ale altei persoane fizice, ori protejarea pe cale administrativă, judiciară sau arbitraj a unor interese legitime a Societății în legătură cu scopul prelucrării.

În cazul în care recrutarea are succes, datele personale colectate vor deveni parte a dosarului de personal necesar pentru încheierea contractului individual de muncă și vor fi prelucrate de către noi conform Notei de informare privitoare la prelucrarea datelor personale ale salariaților noștri (notă de informare care vă va fi prezentată dacă recrutarea are succes).

Dacă (i) recrutarea pentru un post în Societate a eșuat, sau (ii) dacă nu există o poziție deschisă de recrutare în Societate pentru postul vizat de către dumneavoastră, dar totuși am primit date personale de la dumneavoastră în calitate de candidat pentru o eventuală recrutare („candidatură speculativă”), vom șterge datele dumneavoastră primite în scopul recrutării în termen de 180 de zile calendaristice de la data la care recrutarea a eșuat, ori de la data la care am primit aceste date de la dumneavoastră (în cazul candidaturii speculative), cu excepția situației în care suntem nevoiți a documenta și apăra pe cale judiciară sau administrativă drepturile Societății în legătură cu această recrutare.

În cazul în care recrutarea pentru un post în Societate a eșuat, sau nu există o poziție deschisă de recrutare în Societate pentru postul vizat, dar: (i) sunteți de acord sa păstrăm datele dumneavoastră personale pentru campanii de recrutare viitoare ce pot sa apară în Societate, ori (ii) sunteți de acord să transferăm datele dumneavoastră personale către alte societăți din grupul nostrum de firme pentru ca aceste societăți să analizeze dacă este posibilă recrutarea dumneavoastră la o altă societate din grup, Vă vom solicita consimțământul în aceste scopuri prin formularele existente la sediul nostru sau la punctele de lucru ale societății noastre ori pe pagina noastră de internet www.vertical.ro.

Folosim datele cu caracter personal pe care le colectăm de la dvs. când vizitați site-ul nostru de internet vertical.ro, pentru a procesa și a răspunde întrebărilor dvs. transmise prin intermediul formularelor on-line disponibile, precum și pentru a trimite newsletter, serviciu la care  v-ați abonat în prealabil, în timp ce ați vizitat site-ul nostru.

4. DE CE COLECTEAZĂ VERTICAL DESIGN S.R.L.COLLECT THIS DATA? 

We collect the information of data subjects for specific and legitimate purposes as described in this General Privacy Policy, which include but are not limited to:

• To be able to communicate with candidates for company positions.
• To make the right decision regarding their employment.
• To conclude and execute an employment contract according to the specialization/qualifications of candidates.
• To conclude, execute, modify a contract between data subjects and the company.
• To respond to the questions and requests of data subjects.
• To provide and improve the services and products offered by the company.
• To fulfill contractual obligations to you.
• To diagnose or remedy technical problems.
• To defend the company against cyberattacks.
• To conform to legal requirements.
• To establish or defend a right in court.

Astfel, VERTICAL DESIGN S.R.L vă solicită să furnizați categoriile de date cu caracter personal pentru scopurile menționate anterior, deoarece altfel nu putem să îndeplinim acele scopuri, respective să ne desfășurăm activitatea în bune condiții.

If you provide the personal data of other individuals to VERTICAL DESIGN S.R.L., please inform them in advance of how VERTICAL DESIGN S.R.L. intends to process their personal data, as described in this general privacy policy.

5. STOCAREA DATELOR ÎN CADRUL VERTICAL DESIGN S.R.L.

Datele dvs. cu caracter personal sunt stocate pe perioada necesara pentru a respecta diversele obligații legale de către  VERTICAL DESIGN S.R.L..  Este de reținut faptul că în anumite situații expres reglementate, stocăm datele pe perioada care ne este impusă de lege.

Datele cu caracter personal colectate și utilizate pentru abonarea la newsletter-ul nostru vor fi șterse imediat dacă vă dezabonați de la serviciul nostru de newsletter.După încheierea perioadei, datele cu caracter personal ale persoanelor vizate vor fi distruse sau șterse din sistemele informatice sau transformate în date anonime pentru a fi utilizate în scopuri de cercetare științifică, istorică sau statistică.

6. PARTAJAREA INFORMAȚIILOR TALE CU TERȚE PERSOANE:

VERTICAL DESIGN S.R.L. will not disclose the data obtained from data subjects to other third-party companies without having previously obtained express and separate consent for this.

Compania confirmă că datele dvs. cu caracter personal obținute sunt stocate în mod securizat sau sunt distruse, sens în care informăm persoanele vizate că există acorduri de prelucrare a datelor cu furnizorul/furnizorii de software prin care aceștia au asigurat la rândul lor compania că sunt conformi cu GDPR.

VERTICAL DESIGN S.R.L. may disclose the personal data of data subjects in compliance with applicable law to business partners or other third parties, such as our authorized agents.

We continuously make reasonable efforts to ensure that these third parties have implemented appropriate protection and security measures. We have contractual clauses with these third parties to ensure that your data is protected. We will inform data subjects of the identity of these companies before transmission or within a reasonable timeframe and ensure that any transfer is legitimate, based on their consent or another legal basis.

For example, we may provide personal data to other companies, such as IT or telecommunications service providers, banks, accountants, legal services, and other third parties with whom we have a contractual relationship. Deși puțin probabil, compania ar putea vinde în viitor afacerea sau o parte a afacerii, situație care va include transferul  acestor date.

Personal information may be provided to the prosecutor's office, the police, the courts, and other competent authorities, based on and within the limits of legal provisions and as a result of specific requests.

To a reasonable extent, the company will ensure that the personal data of data subjects do not leave the European Economic Area. However, in cases where data is transferred to countries outside the EEA, we will ensure that these transfers are legitimate, always based on the explicit consent of the data subject or another legal basis.

7. VERTICAL DESIGN S.R.L. aduce la cunoștința oricărei persoane fizice vizate faptul că:

• You can withdraw your consent regarding the processing of sensitive data and/or for direct marketing at any time by following the unsubscribe instructions in each email or other electronic message.
• If you wish to exercise your rights, you can do so by registering a written request, which can be submitted at the headquarters/workplace of VERTICAL DESIGN S.R.L.or by sending a written request to the email address office@vertical.ro.
• The rights listed above are not absolute. There are exceptions, which is why each request received will be analyzed to determine whether it is justified or not. To the extent that the request is justified, the company will facilitate the exercise of those rights. If the request is not justified, it will be rejected, but data subjects will be informed of the reasons for refusal and their rights to file a complaint with the Supervisory Authority and to seek judicial remedies.
• The company will attempt to respond to the request as quickly as possible. However, the timeframe can be extended depending on various factors, such as the complexity of the request, the high number of requests received, or the inability to identify you within a reasonable time.
• Dacă, deși depune toate eforturile, compania nu reușeste să identifice persoana vizată, iar aceasta nu îi furnizează informații suplimentare pentru a reuși să o identifice, compania nu va fi obligată  să dea curs solicitării.

8. SOLICITĂRI ȘI EXERCITAREA DREPTURILOR:

În situația în care veți dori să vă exercitați oricare dintre drepturile enumerate mai sus în prezenta Politică Generală de Confidențialitate, să formulați observații sau să obțineți  informații sau clarificări suplimentare cu privire la prelucrarea datelor dvs. personale, dacă aveți întrebări sau nelămuriri cu privire la prelucrarea informațiilor dvs.  sau doriți să vă exercitați drepturile legale sau aveți orice altă îngrijorare cu privire la confidențialitatea asupra datelor dvs., vă rugăm să contactați  VERTICAL DESIGN S.R.L. prin intermediul persoanei desemnate în acest sens, respectiv Dl./ Dna. Tudor Stela la adresa de e-mail office@vertical.ro pentru asigurarea faptului că VERTICAL DESIGN S.R.L. respectă toate cerințele GDPR.

A response to all requests will be provided within the shortest time possible, but not exceeding one month from the receipt of the request, with the possibility of extending the duration by a maximum of two months for complex processing or a large volume of such requests.

It's important to know that the National Authority for Personal Data Processing Surveillance ("A.N.S.P.D.C.P.") operates in Romania, and you have the right to file a complaint when you believe your rights have been violated by accessing the website www.dataprotection.ro.
